Pertimbangan Hakim dalam Putusan Perkara Tindak Pidana Narkotika

ABSTRAK
 Artikel ini bertujuan untuk menganalisis dasar pertimbangan hakim dalam penjatuhan pidana terhadap pelaku penyalahguna narkotika golongan I bagi diri sendiri. Metode penelitian menggunakan hukum Yuridis Normatif. Hasil dari menunjukkan bahwa penyebab menjatuhkan putusan berbeda kedua kasus karena terdapat keadaan yang meringankan terdakwa. Pada studi dipertimbangkan oleh yaitu: terdakwa merupakan korban sudah kecanduan serta didukung dengan keterangan saksi di persidangan. Oleh itu harus mempertimbangkan fakta yuridis, persidangan dan sosiologis Hal dilakukan agar merasa sesuai perbuatan terdakwa.
 ABSTRACT
 This article aims to analyze the basic considerations of judges in convicting criminals against class narcotics abusers themselves. research method is a normative legal research. The results this study indicate that cause judge handed down different verdict these two cases because there were circumstances alleviated defendants. In case mitigating considered by are: defendant victim who are addicted and supported witness testimony at trial. Therefore must consider juridical facts, facts trial sociological defendant. was done so felt criminal according defendant's actions.
